(The 'Game')

Part I
Terms and Conditions of the Game

  1. The Game is brought to you by The Edge Communications Sdn. Bhd. (Company No. 266980-X) of 111, Block F, Phileo Damansara 1, 9 Jalan 16/11, Off Jalan Damansara, 46350 Petaling Jaya, Selangor ('The Edge'). The sponsor of the Game is Hwang-DBS Unit Trust Berhad (Company No. 429786-T) of Suite 12-03, 12th Floor, Menara Keck Seng, 203, Jalan Bukit Bintang, 55100 Kuala Lumpur (the 'Sponsor'). The technical partner of the Game is SignalPoint Sdn. Bhd. (Company No. 576489-W) of 17 SG1/29, Taman Sri Gombak, 68100 Batu Caves, Selangor ('SignalPoint').
  2. Participation in the Game is subject to compliance with the Terms and Conditions of the Game and the Game Rules that are located at http://www.investmentgame.com.my (the 'Game Website'). Players should familiarise themselves with the Terms and Conditions and Game Rules prior to participating in the Game. Any person who participates in the Game is deemed to accept the Terms and Conditions and Game Rules, and will be bound accordingly.
  3. The Edge has sole responsibility for the interpretation of the Terms and Conditions and Game Rules and no correspondence into the same will be entered into.
  4. Players acknowledge that the Game is provided for information and educational purposes only. Players acknowledge that any information supplied in relation to the Game applies only to this Game, and such information should have no bearing on how a person should invest money in unit trust funds. Players acknowledge that such information does not constitute advice or recommendation of any financial products and that players should consider obtaining independent advice before making any financial decision.
  5. Whilst every care has been taken in producing information in relation to the Game, The Edge does not make or imply any representation or warranty as to the reliability, accuracy, or completeness of such information. The Edge shall not be responsible or liable for any incorrect or inaccurate information or incorrect posting of quotes, whether caused by website users or by any of the equipment or programming associated with or utilised in the Game or by any technical or human error which may occur in the processing of submissions in the Game. To the extent permitted by law, no responsibility for any loss (whether in negligence or otherwise) occasioned to anyone acting or refraining from acting as a result of this information and/or the Game is accepted by The Edge.
  6. Players acknowledge that the Terms and Conditions and Game Rules do not necessarily correspond with the actual operations of the unit trusts market, or any other securities market, or any securities regulatory authorities in Malaysia or elsewhere.
  7. The Game is open to all Malaysian residents who are natural persons aged 18 years or over. Employees and their families of The Edge, the Sponsor and SignalPoint or of any companies related to them are not eligible to enter and participate in the Game.
  8. Entry to the Game is free.
  9. Registration for the Game commences on Sunday 1 August 2004. The last day for registration is Saturday 30 April 2005. The Game ends at 4.00 PM on Friday 29 July 2005 (the 'Game Period'). These dates are subject to change without notice.
  10. To enter the Game a person must register by completing and submitting the original registration form that can be found in The Edge's monthly publication, Personal Money or the registration form made available to the invitees of The Edge.
  11. After receipt of the duly completed original registration form, The Edge will notify the player via email of the acceptance of his entry together with the details of the player's Account and password. The player may only commence playing the Game after receipt of the email notification from The Edge. Only players that have been accepted by The Edge may participate in the Game, unless otherwise agreed by The Edge in writing. Any player that allows or enables another person to play the Game using that player's Account will be in breach of the Terms and Conditions and will be automatically disqualified.
  12. Each entry entitles the player to create only one (1) portfolio (the 'Portfolio'). However a player may create more than one (1) Portfolio by submitting additional entries so long as each additional entry is made under the same Account and is accompanied by the submission of an original registration form available in Personal Money. All additional entries are subject to final acceptance by The Edge. After receipt of each additional entry, The Edge will notify the player via email that the entry has been accepted.
  13. Only registrations made using the original registration forms will be accepted. The Edge accepts no responsibility for incomplete, lost, late, misdirected, misplaced or destroyed registration forms.
  14. The Edge may, at any time, deny entry or suspend access to the Game, or disqualify a player from the Game if The Edge:
    • (a) is unable to contact the player who has submitted the registration form; or
    • (b) believes or suspects that the registration form has been, or is submitted by a person other than the person indicated on the registration form, and such person intends to, or has been, participating in the Game under that false or misleading identity.
  15. Players must choose a name (the 'Player Name') to identify themselves with in the Game. Player Names must not be offensive, defamatory, discriminatory or interfere with a trademark or other intellectual property right of any party. The Edge may, in its sole discretion, deem a Player Name to be unacceptable. In the event of a Player Name being deemed unacceptable, The Edge will, in its sole discretion, change the name.
  16. Players are solely responsible for all acts and omissions that occur under their username and password (the 'Account'). The Edge accepts no responsibility for any transactions resulting from unauthorised access to the Account of any player. Players agree to notify The Edge immediately if any unauthorised use of an Account is detected or any other breach of security occurs.
  17. The Edge reserves the right to refuse entry to the Game, or disqualify any person(s) from the Game, at any time, without notice. Without limitation, The Edge also reserves the right to refuse entry to the Game or disqualify any player found to be:
    • (a)tampering with the entry process, the operation of the Game or the Game Website;
    • (b) engaging in practices which, in the sole opinion of The Edge, subverts or is intended to subvert the Terms and Conditions and/or Game Rules;
    • (c) in breach of the Terms and Conditions and/or Game Rules;
    • (d) engaging in insider trading, or market manipulation and/or any other unusual trading;
    • (e) acting in an un-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or
    • (f) engaging in any conduct which, in the sole discretion of The Edge, is deemed to be contrary to, or in breach of, the spirit of the Game.
  18. Players acknowledge that The Edge may use information arising out of the Game, and may pass on the information to the Securities Commission, or any other regulatory or supervisory authority for regulatory and/or supervisory purposes.
  19. Players acknowledge that The Edge may publish on the Game Website or at any other location, details of the current leaders of the Game including the player's Player Name and geographic location.
  20. Players consent to receiving newsletters and other information in electronic, or other format, from The Edge, the Sponsor or any third party from time to time during the Game Period or thereafter. Players acknowledge that the newsletters may contain information that advertises or promotes, or offers to supply, goods or services. For the purpose thereof, players agree that their personal information may be disclosed to the parties deemed appropriate by The Edge.
  21. The prize-winning players will be determined and declared in accordance with the rules set out in the 'Prizes' section of the Game Rules. The decision of The Edge regarding prize-winning players is final and no correspondence will be entered into.
  22. To be eligible for a prize, an entry must meet the following conditions:
    • (a) the player must have complied with the Terms and Conditions and the Game Rules;
    • (b) the player must have completed one purchase transaction for the Portfolio entered not later than one (1) month after acceptance of the entry by The Edge;
    • (c) the player must have completed during the Game Period one or more purchase transactions for the Portfolio having an aggregate value of RM100,000.00; and
    • (d) the player must not have been disqualified from the Game.
  23. Prizes are non-transferable, non-assignable and cash alternatives will not be provided.
  24. Prize-winners agree to participate in any publicity The Edge requires. By accepting a prize, prize-winners automatically grant to The Edge the right to use, or to licence the usage of, their proper names, images, renditions and likenesses without further permission or financial compensation to any person, for any promotional purposes unless prohibited by law.
  25. The Edge reserves the right to amend the Terms and Conditions and Game Rules at any time without notice.
  26. To play the Game, the player must have Netscape Navigator 4.0 or Internet Explorer 5.0 or above. Browsers must be configured to accept Cookies and enable Java and Java Script. Players that use Apple MAC computers or platforms acknowledge that they may experience difficulties accessing certain sections or using certain functions of the Game.
  27. Players release and hold harmless The Edge, the Sponsor and SignalPoint and their respective directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Game or any prize(s) won.
  28. Neither The Edge nor SignalPoint shall be responsible or liable for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment or software including but not limited to failure of e-mail of players on account of technical problems or traffic congestion on the internet or at any website or combination thereof, including injury or damage to players or to any other person's computer related to or resulting from participating or downloading materials in relation to the Game, or player's inability, difficulty or failure to access any electronic site.
  29. If, for any reason, the Game is not capable of running as planned, including without limitation, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of The Edge or SignalPoint, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Game, The Edge reserves the right in its sole discretion to cancel, terminate, modify or suspend the Game and/or access to the Game at any time by giving notice of the same on the Game Website.

Part II
Game Rules

A. Objective of the Game

Players seek to maximise the returns of their Portfolios during the Game Period through any of the following methods:

  1. Invest in unit trust funds
    • Purchase units
    • Purchase units on a regular basis via auto debit setting
  2. Rebalance portfolio
    • Switch from one fund to another fund
    • Redeem units and reinvest in another fund
  3. Redeem units
    • Realise profits from the investment by selling units back to management company
  4. Hold on to cash
    • Invest later

B. Game hours

An order may be made at any time of the day during the Game Period. Orders received before 4.00 PM on a trading day of Bursa Malaysia Securities Berhad ('Trading Day') will be processed on the same day. Orders received after 4.00 PM on a Trading Day or during a non-Trading Day will be processed on the next Trading Day and treated as orders received on the next Trading Day.

C. Unit Transactions

  1. Players may only invest in unit trust funds listed on the Game Website. These are unit trust funds approved by the Securities Commission of Malaysia and in respect of which prospectuses have been registered with the Securities Commission of Malaysia.
  2. Each entry will commence with a Portfolio having a theoretical cash sum of RM100,000.00. Surplus funds may be left as 'cash-on-hand' in the Portfolio. 'Cash-on-hand' held in the Portfolio will not earn any interest. The Edge reserves the right to amend a player's 'cash-on-hand' funds if any errors occur. However, The Edge accepts no liability or responsibility for any loss or damage from any error or the correction thereof.
  3. If a player does not have in his Portfolio holding of units in any unit trust fund managed by a particular management company, the initial purchase of units for the Portfolio in funds managed by the management company must be subject to a cooling-off period of six business days from receipt of the purchase order, during which cancellation may be made by the player.
  4. Purchases or sale/redemptions of units must be made in accordance with the terms and conditions (including the minimum unit requirements) as set out in the prospectuses of the relevant funds.
  5. Forward pricing is used in unit trust transactions i.e. units are purchased and sold at prices of the unit trust funds as published at the end of the Trading Day the orders are received.
  6. Amendment and cancellation of orders are not permitted.
  7. Purchase of units
    • (a) The number of units purchased by a player is calculated by dividing the amount of cash invested with the selling price per unit quoted by the management company of the unit trust fund and may be subject to sales charge levied by the management company.
    • (b) Purchase of units is subject to limitations and requirements (e.g. minimum unit requirements and maximum fund size) as set out in the relevant fund's profile page on the Game Website.
  8. Sale/Redemption of units
    • (a) Cash proceed from sale/redemption of units is calculated by multiplying the number of units sold/redeemed with the buying price quoted by the management company of the unit trust fund.
    • (b) Certain unit trust funds may limit the frequency of sale/redemption or require a minimum number of units for each sale/redemption.
    • (c) Cash proceeds from sale/redemption of units will be added to the player's Portfolio ten (10) days from the date of sale/redemption.
  9. Switching
    • (a) Certain management companies allow switching of units of one unit trust fund to another unit trust fund managed by it.
    • (b) Switching is subject to the requirements, limitations, and fees of the relevant unit trust fund.
    • (c) Units of a unit trust fund managed by a management company cannot be switched to unit trust fund(s) managed by other management companies.
  10. Unit split by the unit trust funds will be calculated automatically and credited to the player's Portfolio after 24:00 hrs of each Trading Day. To receive the additional units a player must already have in his Portfolio holdings of units (not merely orders placed) in those unit trust funds at the close of business the day before the unit split is carried out.
  11. Income distributed by the unit trust funds will be calculated automatically and credited to the player's Portfolio on the re-investment dates of the respective unit trust funds. To receive the income a player must already have in his Portfolio holdings of units (not merely orders placed) in those unit trust funds at the close of business the day before the income is paid.
  12. If transactions in a unit trust fund have been suspended, each player's holding in that unit trust fund will similarly be suspended for the purposes of the Game. The portion of a player's Portfolio allocated to the suspended unit trust fund cannot be utilised to invest in other unit trust funds until the unit trust fund either resumes transaction again or is wound up or terminated. For Portfolio valuation purposes during any period of suspension, the last selling price prior to the day of suspension will be used. News in relation to any suspension will be communicated as soon as practicable via the Game Website. The Edge is not liable for any delay in communicating such information to players.
  13. In the event that a fund is terminated or wound up, the corresponding fund will be terminated or wound up in the Game. In the event that a fund is terminated or wound up, players will receive compensation only if unitholders of that fund receive compensation. There can be several reasons why a fund has been terminated or wound up and it is in The Edge's sole discretion to decide the appropriate course of action in each individual case. News of any termination or winding up will be communicated as soon as practicable via the Game Website. The Edge is not liable for any delay in communicating such information to players.

D. Prizes

  1. A performance review of the Game will be conducted on a quarterly basis. The information will be published in Personal Money and players may use this information to rank their Portfolios against other players' Portfolios.
  2. At the close of the Game Period, final Portfolio values (including 'cash-on-hand' and units) will be automatically valued using the selling prices on the last Trading Day during the Game Period (or such other date as The Edge may determine) as published by the relevant unit trust funds. Players are not required to sell their Portfolios to realise its value at the end of the Game. The Edge reserves the right to alter this valuation methodology without notice if it determines, in its sole discretion, that the valuation thereby derived is not an accurate or appropriate representation of market value. Players are responsible for keeping records of their own transactions, however, a player's final Portfolio executed via the Game Website will be the only evidence of transactions accepted by The Edge.
  3. A total of twenty-five (25) highest valued Portfolios at the end of the Game, as determined by The Edge, will be declared the prize-winning Portfolios. Irrespective of the number of Portfolio a player has entered in the Game, only the highest valued Portfolio of the player is eligible for a prize. The prizes are as follows:
    1st prize Units valued in aggregate at RM80,000 in any one or more Hwang-DBS Unit Trust Fund(s) of the Sponsor's choice

    + 1 year's free subscription of Signal Invest online unit trust consultant information services
    2nd prize Units valued in aggregate at RM50,000 in any one or more Hwang-DBS Unit Trust Fund(s) of the Sponsor's choice

    + 1 year's free subscription of Signal Invest online unit trust consultant information services
    3rd prize Units valued in aggregate at RM30,000 in any one or more Hwang-DBS Unit Trust Fund(s) of the Sponsor's choice
    + 6 months' free subscription of Personal Money magazine
    + 1 year's free subscription of Signal Invest online unit trust consultant information services
    4th prize Units valued in aggregate at RM20,000 in any one or more Hwang-DBS Unit Trust Fund(s) of the Sponsor's choice

    5th prize Units valued in aggregate at RM10,000 in any one or more Hwang-DBS Unit Trust Fund(s) of the Sponsor's choice

  4. In the event that there is a tie between the final Portfolio values of two or more players at the conclusion of the Game, the prizes will be shared amongst them equally.
  5. The prize-winning players will be notified by email, telephone, and/or courier within fourteen (14) days of such declaration. Prize-winners must respond from their registered email address within forty eight (48) hours of receiving such notification, and in such response must provide their legal name, Malaysian NRIC Number (both old and new), residential mailing address, contact phone number and date of birth to be eligible to receive prizes. If any potential prize-winning player(s) cannot be contacted within seven (7) days after notification, or are otherwise deemed ineligible to receive a prize, the player will not receive the prize, and an alternate player will be selected according to the standings from all remaining eligible players. The Edge will also announce the prize-winners of the Game in Personal Money and any other media as The Edge may deem appropriate.
